Terms of Service

These Terms of Service (“Terms”) form an agreement between you and the operator of BitBuild governing access to the BitBuild website, workspace, AI analysis, reports, and subscriptions. By creating an account, purchasing a subscription, or using the Service, you accept these Terms and our Privacy Policy.

1. Eligibility and acceptance

You must be at least 18 and legally able to contract. If you use the Service for an organization, you represent that you are authorized to bind it. Do not use the Service if you do not agree to these Terms.

2. The Service

BitBuild is a digital software service using AI to assist with renovation or construction drawings, quantity takeoffs, quotation review and comparison, potential omission and risk identification, and downloadable reports. Paid digital access is delivered immediately after payment confirmation.

We may use Volcengine Ark, Doubao, or other third-party AI models and cloud services. Models, features, and providers may change for technical, compliance, or availability reasons.

3. Accounts and security

• Provide accurate, complete, and current registration and billing information.
• Protect your login credentials and accept responsibility for account activity.
• Do not share, rent, or sell accounts or bypass usage or security controls.
• Report unauthorized use or security issues promptly to neohoy@gmail.com.

4. Plans and subscriptions

BitBuild may offer a free plan and monthly subscriptions. The current reference price for Plus monthly is USD 9.90 per month and includes the monthly usage allowance displayed in the product or at checkout. Features, allowances, currency, tax, and final price are those shown when you purchase.

We may introduce, change, or retire plans. Material adverse price changes for an existing paid subscription will be notified before the next renewal period.

5. Automatic renewal, payment, and tax

5.1 Renewal authorization

By subscribing, you authorize BitBuild and the payment provider shown at checkout to charge your payment method at the start of each billing period for the then-current price and applicable tax until cancellation.

5.2 Payment processing

Payments may be processed by Waffo Pancake, Lemon Squeezy, or another compliant payment partner displayed at checkout. A provider may act as merchant of record for payment, taxes, receipts, refunds, and disputes. BitBuild does not store complete card numbers or security codes.

5.3 Tax and failed payments

Unless checkout states otherwise, prices may exclude VAT, GST, sales tax, or similar charges. If payment fails, we may retry, limit paid features, or mark the subscription past due and notify you to update payment details.

6. Cancellation

You may cancel renewal through “Account Settings → Subscription and Usage → Manage Subscription,” which opens the payment provider's customer portal. If unavailable, email neohoy@gmail.com from your registered address. Cancel before the next charge.

• Paid access ordinarily continues through the end of the current paid period.
• No further renewal charge occurs after the current period, and the account moves to the then-available free plan.
• Cancellation does not delete your account; account deletion is available separately in settings.

7. Refund Policy

Digital service is delivered immediately, so subscription fees are generally non-refundable except below and where law requires otherwise:

• Low-usage request: you may request a refund when usage in the current subscription period is 0–2 runs. At 3 or more runs, the period is ordinarily ineligible for a voluntary refund.
• Duplicate or incorrect charge: a confirmed duplicate or billing error will be refunded.
• Extended outage: if our core paid Service is continuously unavailable for more than 72 hours due to us, we may provide a proportional refund or service extension.
• Statutory rights: mandatory cancellation, cooling-off, and refund rights under applicable law remain unaffected.

Submit a request in the subscription page or email neohoy@gmail.com from your registered address with the account email, order ID, and reason. A request is not a completed refund. Approved refunds are ordinarily returned by the original payment provider to the original method; timing depends on financial institutions.

8. Billing disputes

If you believe a charge is incorrect, contact neohoy@gmail.com within 30 days of discovery so we can investigate and coordinate with the payment provider. This does not limit non-waivable dispute or chargeback rights.

9. Your content and intellectual property

You retain rights in files, instructions, and resulting output that you lawfully own. You grant us a limited, non-exclusive license, lasting only as necessary, to receive, store, transform, transmit, and process content to provide, maintain, and protect the Service.

We do not use project files to train BitBuild-owned models without explicit consent. You represent that you hold all rights and permissions needed to upload and process content.

BitBuild software, interfaces, branding, templates, and service technology remain owned by us or our licensors. No ownership in them transfers to you.

10. Acceptable use

You must not:

• Use the Service for unlawful, fraudulent, infringing, harassing, or harmful activity.
• Upload malware or attack, test, or bypass security, authentication, quotas, or access controls.
• Process personal data, trade secrets, drawings, or protected content without permission.
• Systematically scrape, bulk extract, resell outputs, or use them to train a model directly competing with BitBuild.
• Misrepresent AI output as advice produced by a licensed engineer, quantity surveyor, lawyer, or other professional.
• Use automation that imposes abnormal load on the Service, providers, or other users.

11. Privacy and data

We handle personal information and project content under the BitBuild Privacy Policy. Upload only data needed for the task and satisfy any notice, permission, or confidentiality duties applicable to you.

12. AI and professional disclaimer

AI output may be inaccurate, incomplete, outdated, or unsuitable for a project. BitBuild reports are for information organization and decision support only. They do not replace site measurement, official construction drawings, contract review, or licensed engineering, cost, architecture, legal, financial, or other professional advice.

Before signing a contract, making payment, purchasing materials, or starting work, verify source documents and site conditions and obtain review from qualified professionals. You are responsible for how you use outputs and resulting decisions.

13. Availability and changes

The Service is provided “as is” and “as available.” We do not promise uninterrupted operation or completely accurate output. We may pause or modify it for maintenance, security, legal, or provider reasons and will give reasonable notice of material changes when practicable.

14. Suspension and termination

We may suspend or terminate an account for material breach, fraud or security risk, nonpayment, or legal requirements. If we permanently discontinue prepaid Service for reasons unrelated to your breach, we will provide a reasonable proportional refund for unused time or another remedy required by law.

15. Limitation of liability

To the maximum extent permitted by law, BitBuild is not liable for indirect, incidental, special, punitive, or consequential damages, or loss of profit, data, or opportunity. Our aggregate Service liability will not exceed fees you actually paid during the 12 months before the event giving rise to the claim. Liability that cannot legally be excluded or limited remains unaffected.

16. Governing law, disputes, and general terms

These Terms are governed by laws applicable at the BitBuild operator's principal location, without affecting mandatory consumer rights where you live. Contact us first for good-faith informal resolution; unresolved matters may be brought before a court with jurisdiction or an available consumer dispute body.

If part of these Terms is invalid, the rest remains effective. Delay in enforcing a right is not a waiver. You may not assign this agreement without our consent; we may assign it in a business reorganization while continuing to protect your rights.

17. Changes to these Terms

We may update these Terms. Material changes will be notified at least 14 days in advance by website, account, or registered email. Urgent changes required for law, security, or abuse prevention may take effect immediately. Continued use after the effective date means acceptance.
